1. General Provisions
1.1. These Terms of Use govern the procedure for using the software service (hereinafter referred to as the System) posted on the Contractor's Website.
1.2. Use of the System constitutes the full and unconditional consent of the System user (hereinafter referred to as the Licensee) to the terms of these Terms of Use, the Offer, the System Use Rules, the Acceptable Use Policy, and the Privacy Policy.
1.3. The System is a set of computer programs (a hardware-software complex) hosted on the equipment of the Contractor and/or third parties, providing automation of processes for managing the network settings of the Licensee's equipment and data exchange between devices in accordance with specified algorithms.
1.4. The Contractor is not a telecommunications operator, does not provide communication services, does not own the network infrastructure used for transmitting internet traffic, and does not assume obligations to ensure communication within the meaning of the telecommunications legislation of the Russian Federation.
1.5. All network resources, including IP addresses, data transmission channels, routes, proxy nodes, and other technical means used in the operation of the System, are provided or maintained by third parties.
1.6. The Contractor grants the Licensee the right to use the System within its functional capabilities and under the terms provided for by the Offer and other documents posted on the Website.
1.7. IP addresses, proxy resources, communication channels, equipment, and other technical means are not transferred to the Licensee for ownership, use, lease, or by any other proprietary or obligatory means.
2. Registration and Account
2.1. To use the System, the Licensee must complete the registration procedure.
2.2. Registration is carried out using an email address, which is used as a login to access the System.
2.3. During registration, the Licensee must:
- provide a valid email address;
- create a password;
- provide accurate registration data.
2.4. After registration, the Licensee is granted access to the Personal Account.
2.5. The Personal Account is intended for:
- managing the account;
- purchasing a usage limit;
- obtaining access parameters;
- viewing System usage statistics.
2.6. The Licensee must ensure the confidentiality of their account credentials, including login, password, and other means of access to the System.
2.7. All actions performed through the Licensee's account are deemed to have been performed by the Licensee themselves, unless proven otherwise.
2.8. The Licensee must use a valid email address when registering and working in the System, keep the registration data up to date, and independently control access to the specified email address.
3. Use of the System
3.1. Use of the System is based on a simple non-exclusive license granted in accordance with the Offer.
3.2. Within the functionality of the System, the Licensee may be provided with the ability to:
- use the System's software interface;
- send internet requests through available network routes and IP addresses of third parties;
- track and expend the purchased usage limit;
- manage access parameters through the System interface and Personal Account.
3.3. Use of the System is permitted only within the functionality provided by the Website interface, the Offer, these Terms of Use, and other documents posted on the Website.
3.4. The Licensee understands and agrees that data transfer when using the System occurs between the Licensee's software and third-party software interfaces. The Contractor merely provides a software algorithm that allows automatically changing the connection parameters of the Licensee's equipment and software to carry out such transfer.
4. Usage Limit
4.1. To use the System, the Licensee purchases a usage limit.
4.2. The usage limit is a technical parameter that determines the maximum volume of data exchange operations available when using the System during the license validity period.
4.3. The Licensee independently determines the required amount of usage limit.
4.4. After payment of the corresponding usage limit, the right to use the System within its limits is granted for a period of 31 (thirty-one) calendar days from the moment of activation, unless a different activation moment is expressly indicated in the System interface.
4.5. Upon expiration of the specified period:
- access to the corresponding usage limit is terminated;
- the unused usage limit is canceled.
4.6. The unused usage limit:
- is not carried over to the next period;
- is not automatically aggregated with a new limit, unless expressly stated otherwise on the Website;
- is not compensated;
- is not subject to refund.
4.7. To continue using the System, the Licensee must purchase a new usage limit.
5. Use of Third-Party Infrastructure
5.1. The algorithms embedded in the System involve interaction with public data transmission networks owned by third parties.
5.2. The Contractor is not the owner of this infrastructure and is not a party to legal relationships arising between the Licensee and the owners of such networks, including telecommunications operators, providers, hosting providers, and other persons.
5.3. The Contractor does not guarantee:
- the availability of specific IP addresses;
- the consistency of IP address geolocation;
- the compliance of geolocation data with information in third-party services;
- the compatibility of the System with all websites, platforms, browsers, applications, and devices;
- the absence of restrictions, blocks, or sanctions from third parties.
5.4. Any risks associated with the use of third-party infrastructure, including blocks, restrictions, access denials, connection instability, geolocation mismatches, and other similar circumstances, are borne by the Licensee.
6. Security
6.1. The Contractor takes necessary technical and organizational measures to ensure the security of the Website and System, including:
- protection against unauthorized access;
- protection against malicious software;
- prevention of unauthorized access to the Licensee's confidential information and its loss, alteration, blocking, copying, distribution, and other unlawful actions by third parties.
6.2. Despite the measures taken, the Contractor cannot guarantee absolute security of the System against all possible threats.
6.3. The Licensee must independently ensure the security of the devices, software, credentials, and access channels used to access the System.
7. Limitation of Liability
7.1. The System is provided on an "as is" basis.
7.2. The Contractor does not guarantee that:
- the System will fully meet the Licensee's expectations;
- the use of the System will be continuous, uninterrupted, and error-free;
- all internet resources will be accessible when using the System;
- the purchased usage limit will be actually used by the Licensee before its expiration.
7.3. The Contractor is not liable for:
- actions of the Licensee when using the System;
- blocks of accounts, personal accounts, and other accounts on third-party services;
- restrictions imposed by websites, services, and platforms;
- losses arising from the use of the System;
- failures, interruptions, and other problems in the operation of third-party infrastructure;
- consequences of the Licensee violating the law.
7.4. Use of the System is at the Licensee's own risk.
8. Restriction and Blocking of Access
8.1. The Contractor has the right to restrict, suspend, or terminate the Licensee's access to the System in the event of:
- violation of these Terms of Use;
- violation of the Offer;
- violation of the System Use Rules;
- violation of the Acceptable Use Policy;
- unlawful use of the System;
- creation of a threat to the System, the Contractor, partner infrastructure, or third parties.
8.2. In such cases, access may be restricted or terminated without a refund.
9. Change of Terms
9.1. The Contractor has the right to change the terms of these Terms of Use at any time.
9.2. The current version of the Terms of Use is published on the Website.
9.3. Continued use of the System after the changes take effect constitutes the Licensee's acceptance of the updated terms.
