Rules for Use of the System
1. General Provisions
1.1. These Rules for Use of the System govern the procedure for using the software service (the “System”) made available on the Licensor’s Website.
1.2. The Licensor is the person or entity (individual entrepreneur or legal entity) granting the right to use the System under the terms set out in the Offer.
1.3. The System is a suite of software for computers and related technical infrastructure (software and hardware complex) hosted on the equipment of the Licensor and/or third parties, intended to automate management of the Licensee’s equipment network settings and data exchange between devices in accordance with specified algorithms.
1.4. The Licensee is an individual, sole proprietor, or legal entity that has accepted the Offer and uses the System.
1.5. The Licensor is not a telecommunications operator, does not provide communications services, and does not own the network infrastructure used for internet traffic transmission.
1.6. Network resources, including IP addresses, data transmission channels, proxy nodes, routes, and other technical means used in the operation of the System, are provided or maintained by third parties.
1.7. The Licensor provides the Licensee with software-based access to third-party infrastructure through the algorithms and software interfaces of the System.
1.8. The Licensor does not transfer IP addresses, proxy servers, communication channels, or other network resources to the Licensee into ownership, lease, possession, or use.
1.9. By using the System, the Licensee confirms acceptance of:
- these Rules for Use of the System;
- the Offer;
- the User Agreement;
- the Acceptable Use Policy;
- the Privacy Policy.
2. Registration in the System
2.1. To use the System, the Licensee must complete the registration procedure.
2.2. Registration is carried out using an email address, which is used as the login credential for access to the System.
2.3. During registration, the Licensee must:
- provide a valid email address;
- create a password for access to the account;
- provide accurate registration information.
2.4. After registration, the Licensee is granted access to the Personal Account.
2.5. The Personal Account is the Licensee’s personal section on the Website intended for:
- managing the license;
- purchasing the Usage Limit;
- obtaining connection parameters;
- viewing statistics on use of the System;
- viewing information on the Frozen Remainder and the duration of its freezing period.
2.6. The Licensee must ensure the confidentiality of its account credentials and must not transfer them to third parties.
2.7. All actions performed through the Licensee’s account shall be deemed to have been performed by the Licensee unless proven otherwise.
2.8. The Licensee must use a valid email address when registering and using the System, keep registration information up to date, and independently control access to the specified email address.
3. Scope of Use of the System
3.1. Use of the System is carried out on the basis of a limited non-exclusive license granted in accordance with the Offer.
3.2. Within the functionality of the System, the Licensee may be provided with the ability to:
- send internet requests through third-party IP addresses and network routes;
- use the software interface of the System;
- manage access parameters through the software interface of the System;
- track and consume the purchased Usage Limit.
3.3. Data transmission when using the System takes place between the Licensee’s software and the software interfaces of third parties.
3.4. The Licensor provides a software algorithm enabling automatic modification of the connection parameters of the Licensee’s equipment for the purpose of data transmission.
3.5. The actual process of data transmission is carried out through third-party equipment and networks and is not the subject matter of these Rules.
3.6. Use of the System is permitted solely within the functionality provided by the Website interface, these Rules, the Offer, and other documents published on the Website.
4. Usage Limit and License Term
4.1. To use the System, the Licensee purchases a Usage Limit.
4.2. The Usage Limit is a technical parameter defining the maximum volume of data exchange operations available when using the System.
4.3. The Licensee independently selects and purchases the required volume of Usage Limit.
4.4. Upon payment for the Usage Limit, the Licensee is granted the right to use the System for a period of 31 (thirty-one) calendar days from activation, unless another activation moment is expressly stated in the System interface.
4.5. Upon expiration of that period, access to the unused portion of the Usage Limit shall terminate, and such unused portion shall be transferred into Frozen Remainder status for 14 (fourteen) calendar days.
4.6. During the freezing period, the Frozen Remainder is unavailable for use until the Licensee pays for a new Usage Limit.
4.7. If a new Usage Limit is paid for during the freezing period, the Frozen Remainder shall be aggregated with the newly purchased Usage Limit. From activation of the new Usage Limit, the Licensee shall be granted the right to use the total aggregated Usage Limit for a new period of 31 (thirty-one) calendar days, unless otherwise expressly stated in the System interface.
4.8. If the Licensee does not pay for a new Usage Limit within 14 (fourteen) calendar days from the beginning of the freezing period, the Frozen Remainder shall be canceled without any compensation.
4.9. To continue using the System, the Licensee must purchase a new Usage Limit before expiration of the current term or during the freezing period.
4.10. The Licensee independently calculates the required volume of Usage Limit.
4.11. The Licensor shall not be responsible for the Licensee’s selection of an unsuitable Usage Limit volume.
5. Payment Procedure
5.1. Use of the System is provided on a prepaid basis.
5.2. By topping up the balance or purchasing a Usage Limit, the Licensee confirms acceptance of these Rules and the terms of the Offer, including the terms relating to the validity period of the paid package, freezing of the unused remainder, and the procedure for its possible restoration.
5.3. Funds paid by the Licensee are used for:
- acquiring a license to use the System;
- paying for the Usage Limit.
5.4. Payment may be made by the methods available in the System interface.
6. Refund Policy
6.1. Since access to the functionality of the System is provided after activation of the license and technical enablement of the paid Usage Limit, no refund shall be made for a purchased Usage Limit except where expressly provided in the Offer.
6.2. Unused Usage Limit, including the Frozen Remainder, is not subject to:
- refund;
- exchange;
- compensation.
6.3. An exception may apply in the event of complete technical inability to provide access to the System due to the Licensor’s fault.
6.4. Inability to use individual internet resources, blocked accounts, or restrictions imposed by websites, services, or platforms shall not constitute grounds for a refund.
7. Use of Third-Party Infrastructure
7.1. The System may use third-party provider infrastructure, including:
- residential IP addresses;
- proxy nodes;
- network routes;
- software-based data transmission gateways.
7.2. The Licensor is not the owner of such infrastructure and cannot fully control its operation.
7.3. Availability of IP addresses, their geolocation, and operational stability may depend on third-party providers.
7.4. The Licensor does not guarantee:
- availability of individual internet resources;
- absence of blocks;
- exact correspondence of IP geolocation with data shown in third-party services;
- compatibility of the System with all third-party services.
8. System Security
8.1. The Licensor takes necessary technical and organizational measures to ensure the security of the Website and the System, including:
- protection against unauthorized access;
- protection against malicious software;
- prevention of leaks of Licensees’ confidential information.
8.2. Despite the security measures in place, the Licensor cannot guarantee absolute protection of the System against all possible threats.
8.3. The Licensee undertakes to independently take measures to protect its credentials, software, and devices used to access the System.
9. Prohibited Conduct
9.1. The Licensee undertakes not to use the System for:
- violating the laws or regulations of any jurisdiction;
- conducting hacking attacks;
- distributing malicious software;
- phishing and fraudulent schemes;
- conducting DDoS or DoS attacks;
- unlawful collection of personal data;
- mass distribution of spam;
- infringement of copyright or other intellectual property rights;
- distribution of unlawful content;
- use of the System in any way that violates applicable law.
9.2. The following are also prohibited:
- interference with the operation of the System;
- attempts to bypass technical restrictions;
- creation of excessive load on the System infrastructure.
9.3. If violations are identified, the Licensor may:
- restrict access to the System;
- suspend the license;
- block the Licensee’s account without any refund.
10. Limitation of Liability
10.1. The System is provided on an “as is” basis.
10.2. The Licensor shall not be liable for:
- the Licensee’s actions when using the System;
- blocks imposed by internet resources;
- restrictions on access to websites;
- losses arising from use of the System;
- interruptions in the operation of third-party infrastructure;
- incompatibility of the System with the Licensee’s software;
- inability to use the Usage Limit in full before expiration of its validity period or freezing period.
