1. General Provisions
1.1. These System Use Rules regulate the procedure for using the software service (hereinafter referred to as the System) posted on the Contractor's Website.
1.2. Contractor — a person (individual entrepreneur or legal entity) granting the right to use the System under the terms set forth in the Offer.
1.3. The System is a set of computer programs (a hardware-software complex) hosted on the equipment of the Contractor and/or third parties, providing automation of processes for managing the network settings of the Licensee's equipment and data exchange between devices in accordance with specified algorithms.
1.4. Licensee — an individual, individual entrepreneur, or legal entity that has accepted the Offer and is using the System.
1.5. The Contractor is not a telecommunications operator, does not provide communication services, and does not own the network infrastructure used for transmitting internet traffic.
1.6. Network resources, including IP addresses, data transmission channels, proxy nodes, routes, and other technical means used in the operation of the System, are provided or maintained by third parties.
1.7. The Contractor provides the Licensee with software access to the infrastructure of third parties through the algorithms and software interfaces of the System.
1.8. The Contractor does not transfer IP addresses, proxy servers, communication channels, or other network resources to the Licensee for ownership, lease, or use.
1.9. By using the System, the Licensee confirms consent to:
- these System Use Rules;
- the Offer;
- the Terms of Use;
- the Acceptable Use Policy;
- the Privacy Policy.
2. Registration in the System
2.1. To use the System, the Licensee must complete the registration procedure.
2.2. Registration is carried out using an email address, which is used as a login to access the System.
2.3. During registration, the Licensee must:
- provide a valid email address;
- create a password to access the account;
- provide accurate registration data.
2.4. After registration, the Licensee is granted access to the Personal Account.
2.5. Personal Account — the Licensee's personal section on the Website, intended for:
- managing the license;
- purchasing a usage limit;
- obtaining connection parameters;
- viewing System usage statistics.
2.6. The Licensee must ensure the confidentiality of their account credentials and not transfer them to third parties.
2.7. All actions performed through the Licensee's account are deemed to have been performed by the Licensee themselves.
3. Subject of System Use
3.1. Use of the System is based on a limited non-exclusive license granted in accordance with the Offer.
3.2. Within the functionality of the System, the Licensee may be provided with the ability to:
- send internet requests via IP addresses;
- use network routes of third-party providers;
- manage access parameters through the System's software interface.
3.3. Data transfer when using the System occurs between the Licensee's software and third-party software interfaces.
3.4. The Contractor provides a software algorithm that allows automatically changing the connection parameters of the Licensee's equipment for data transmission.
3.5. The data transfer process itself is carried out through third-party equipment and networks and is not the subject of these Rules.
3.6. Use of the System is permitted only within the functionality provided by the Website interface and these Rules.
4. Usage Limit and License Validity Period
4.1. To use the System, the Licensee purchases a usage limit (computing resource limit).
4.2. The usage limit is a technical parameter that determines the maximum volume of data exchange operations available when using the System.
4.3. The Licensee independently selects and purchases the required amount of usage limit.
4.4. After payment, the Licensee is granted the right to use the System for a period of 31 (thirty-one) calendar days from the moment of activation.
4.5. After the expiration of this period, access to the unused usage limit is terminated.
4.6. The unused usage limit:
- is not carried over to the next period;
- is not automatically aggregated with a new limit;
- is canceled without compensation.
4.7. To continue using the System, the Licensee must purchase a new usage limit.
4.8. The Licensee independently calculates the required amount of usage limit.
4.9. The Contractor is not liable for the Licensee's choice of an unsuitable usage limit amount.
5. Payment Procedure
5.1. Use of the System is subject to advance payment.
5.2. By topping up the balance or purchasing a usage limit, the Licensee confirms their consent to the terms of these Rules and the terms of the Offer.
5.3. Funds deposited by the Licensee are used for:
- acquiring a license to use the System;
- paying for the usage limit.
5.4. Payment can be made using methods available in the System interface.
6. Refund Policy
6.1. Since access to the System's functionality is granted immediately after license activation, refunds for the purchased usage limit are not provided.
6.2. The unused usage limit is not subject to:
- refund;
- exchange;
- compensation.
6.3. An exception may be a case of complete technical impossibility of providing access to the System due to the Contractor's fault.
6.4. The inability to use individual internet resources, account blocks, restrictions imposed by websites, services, or platforms are not grounds for a refund.
7. Use of Third-Party Infrastructure
7.1. The System may use the infrastructure of third-party providers, including:
- residential IP addresses;
- proxy nodes;
- network routes;
- software data transmission gateways.
7.2. The Contractor is not the owner of this infrastructure and cannot fully control its operation.
7.3. The availability of IP addresses, their geolocation, and stability of operation may depend on third-party providers.
7.4. The Contractor does not guarantee:
- the availability of specific internet resources;
- the absence of blocks;
- exact compliance of IP address geolocation with data from third-party services;
- compatibility of the System with all third-party services.
8. System Security
8.1. The Contractor takes necessary technical and organizational measures to ensure the security of the Website and System, including:
- protection against unauthorized access;
- protection against malicious software;
- prevention of leakage of Licensees' confidential information.
8.2. Despite the security measures taken, the Contractor cannot guarantee absolute security of the System against all possible threats.
8.3. The Licensee undertakes to independently take measures to protect their account credentials, software, and devices used to access the System.
9. Prohibited Actions
9.1. The Licensee undertakes not to use the System for:
- violating the laws of any jurisdiction;
- conducting hacker attacks;
- distributing malicious software;
- phishing and fraudulent schemes;
- conducting DDoS / DoS attacks;
- illegal collection of personal data;
- mass spam mailing;
- infringing copyrights;
- distributing illegal content;
- using the System in ways that violate applicable law.
9.2. It is also prohibited to:
- interfere with the operation of the System;
- attempt to circumvent technical restrictions;
- create excessive load on the System's infrastructure.
9.3. Upon detection of violations, the Contractor has the right to:
- restrict access to the System;
- suspend the license;
- block the Licensee's account without a refund.
10. Limitation of Liability
10.1. The System is provided on an "as is" basis.
10.2. The Contractor is not liable for:
- actions of the Licensee when using the System;
- blocks imposed by internet resources;
- access restrictions to websites;
- losses arising from the use of the System;
- interruptions in the operation of third-party infrastructure;
- incompatibility of the System with the Licensee's software.
10.3. Use of the System is at the Licensee's own risk.
11. Rule Changes
11.1. The Contractor has the right to change these Rules at any time.
11.2. The current version of the Rules is published on the Website.
11.3. Continued use of the System after changes are made constitutes the Licensee's acceptance of the updated terms.
